Modecom Polska Sp. z o.o. ("We", "us", "our") offers its products via an online store located in the volcanogaming.pl domain ("Store").

These Regulations define the rules for your (customers browsing the Store's content or placing orders) to use our Store, place orders for the products we offer and the terms of their delivery or advertising. The content of the Regulations can be saved (CTRL + S) or printed (CTRL + P) using the usual functions of your web browser.

By creating an account in our Store, you accept these Regulations and the Privacy Policy (the content of which you can check

here). Read their content and do not purchase our products if you do not accept the Regulations or the Privacy Policy. We reserve the right to amend the Regulations - you will be informed about it by making the uniform text of the Regulations available on this subpage. The change comes into force on the date indicated by us, but not earlier than within 7 days from the day the uniform text of the Regulations is made available in the Store. Changing the provisions of the Regulations does not affect the terms of contracts concluded before their entry into force.

The products we sell

All products offered through the Website are new and free from physical and legal defects.

Creating an account in the Store

The purchase of the goods we offer requires the creation of an account in the Store or the provision of personal data and delivery address data when purchasing a given product. However, creating an account shortens the ordering process and also disables the need to provide data each time when placing another order. Setting up an account requires entering an e-mail address and setting a password for the account, you can also set them up via Facebook. By creating an account, you undertake to provide complete and up-to-date information about yourself. You may not transfer the rights to your account created in the Store to anyone else or allow anyone else to use it. You should protect the security of your account and the password that protects it, you should not share the password to your account in the Store with anyone. You can register in our Store and purchase the offered products if you have full legal capacity (you are of legal age). If you are a person without full legal capacity, you can only purchase products after obtaining the consent of your parent, guardian or legal representative. If you are acting on behalf of an organization, legal entity or other entity, you should be entitled to use the Store and to act on their behalf. After creating an account, you will be able to provide additional information in the account profile, e.g. delivery addresses or contact numbers, or specify your preferred payment method.

Placing orders

By clicking on the Place Order button, a binding order is placed for the products in the shopping cart. We confirm placing an order by e-mail immediately after sending the order. The conclusion of the contract takes place when you receive the order confirmation. If we are unable to fulfill the order, e.g. due to the fact that the products are exhausted, we will notify you by e-mail and we will immediately refund the price paid by you. If you wish, we can also change your order by providing you with another product of your choice and making appropriate settlements for the price difference. We reserve that the ordered products are shipped after paying the full price. Orders are processed in Poland - the availability of the delivery can be checked in the delivery options. The prices quoted at the time of ordering apply. All prices quoted by us are gross prices including VAT. Until the full payment of the sale price, the product remains our property. When placing an order, you will be informed about the cost of delivery before placing the order. We offer the following types of payment in our Store: Stripe, PayPal, Google Pay, Apple Pay. For each order, we reserve the right not to offer some types of payment. All refunds are made automatically to the account you use to pay for the ordered product. In case of payment by online transfer, payments will be refunded to the account from which the transfer was made, see our privacy policy for more information on credit card security.

Intellectual Property Rights

Photos, descriptions and other information as accurately as possible reflect the products we offer in the Store. We undertake to make every effort to ensure that the presented information on products is up-to-date, complete and consistent with the facts. All rights to the Store and the products offered, in particular intellectual property rights to the name, trademarks, domain, form, graphics, articles, photos, belong to us or our business partners. Copying or disseminating them may violate our rights or the rights of our business partners.

Information sent

It is forbidden to provide, send, or transfer any illegal content by Store users. If you learn about any unlawful activity of another user, you should inform us immediately by sending an e-mail to the address provided at the beginning of the Regulations. We have the right to moderate or remove all or part of the statements and other content posted in the Store that violate the provisions of these Regulations in force legal provisions or good manners, or may harm our good name or expose us to any liability.

Technical requirements necessary to use the Store

The technical requirements necessary to cooperate with the Store's IT system are as follows:

Withdrawal from the contract

You have the right to withdraw from the sales contract for any product purchased from us, within 14 days, without giving any reason. The withdrawal period runs from the day on which you (or a non-carrier person indicated by you, e.g. a household member) came into possession of the product. To meet the deadline, it is sufficient for you to send your notification before its expiry, with an unequivocal declaration of will (e.g. by letter or e-mail). You can use the model withdrawal form available here for this purpose. If you withdraw from the contract for the sale of a product, we will refund all payments received, including delivery costs (but not later than within fourteen days from the date of receipt of your notification) except for additional costs that may arise due to your choice of a delivery method other than the cheapest standard delivery method offered by us). The payment will be refunded automatically to the account used by you to pay for the purchased product, unless we mutually agree on a different method of return. We may refuse to refund the payment until we receive the returned product or until you provide us with proof that the product has been sent to us. Remember, you should send the product back to us immediately, but no later than fourteen days from the day on which you informed us of your withdrawal from the contract. As with the withdrawal itself, the deadline is deemed to have been met if the product is dispatched before the fourteen days expiry and that you are responsible for any diminished value of the product resulting from any use beyond what is necessary to establish its nature, characteristics or operation of this product.

Complaints procedure

You can submit each complaint to us in writing, by e-mail or by phone to the addresses and numbers indicated at the beginning of the Regulations. If the data or information provided in the complaint need to be supplemented, before considering it, we will ask you to supplement it in the indicated scope. We will try to consider your complaint as soon as possible, we promise that it will not take more than 14 days. You will receive a response to the complaint to the e-mail address assigned to your account in the Store or via e-mail, and if this data is not known to us - in writing. it will be possible to refund the amount due for the advertised product within fourteen days from the date of considering the complaint. Instead of the defect removal method proposed by us, you can request the product to be replaced with a defect-free one, or instead of replacing it, you can demand that the defect be removed, unless it is impossible to bring the product into conformity with the contract in a manner chosen by you or would require excessive costs compared to the method proposed by us. sold in our Store may be covered by a warranty provided by their producer or distributor. We do not provide any warranty for any products sold through the Store. In the case of products for which the manufacturer or distributor has granted a warranty, you can make a complaint about a defective product using the rights resulting from the warranty - in this case you will make a complaint directly to the guarantor (the entity granting warranty), and we will only be an intermediary for transferring the complaint.
